Karnataka Creche Rules notified for establishments

Karnataka has become the first Indian state to implement rules for crèche facility to be provided to female employees as per the Maternity Benefit Act, 1961 of India. The state Government of Karnataka was first to release Draft crèches Rule in July 2018 and subsequently came up with Karnataka Maternity Benefit (Amendment) Rules 2019. This rule has come into effect from 8th August 2019 vide Gazette Notification No. LD-127-LET-2018.

The rules, inter alia, mandate employers having 50 or more employees to provide and maintain a crèche for the use of children who are below the age of six years. The crèche is to be located within the premises of the establishment or within five hundred (500) meters from the entrance gate of the establishment.  

Key features of the Rules

Eligibility:

Every establishment employing 50 or more employees is required to have a crèche facility as per the Maternity Act. Further this facility should be provided to all employees irrespective of type and nature of employment

Age of children:

This crèche facility has be available for all children below six years of age


Location:

The crèche must be located within the premises of the establishment or within 500 metres from the entrance gate of the establishment

Threshold Counts:

There shall be one crèche for every thirty children.

Timing:

The facility must be open during the working hours of the establishment

Facilities and amenities:

Basic and essential amenities must be available like safe drinking water, clean towels & soap, essential equipment for children, first-aid kits, supply of milk and refreshments.
